A coalition of environmental non-profits, including Earthjustice, Healthy Gulf, the Sierra Club, the Turtle Island Restoration Network, and Friends of the Earth, has filed a lawsuit challenging the legality of the U.S. government's decision to exempt offshore oil and gas companies in the Gulf of Mexico from the Endangered Species Act (ESA).

Government Action and Legal Challenge

Following a unanimous vote by the Endangered Species Committee, convened at the request of the Department of Defense citing national security, the Departments of the Interior and Defense declared that offshore operators are no longer bound by the ESA. The lawsuit, filed in a District of Columbia court, argues this exemption is illegal. The plaintiffs contend the administration failed to follow the proper legal procedures established by Congress for granting such waivers, comparing the hasty, single-day committee meeting to the weeks-long, transparent hearings held for past cases like the spotted owl in the 1990s.

Environmental and Economic Concerns

Environmentalists warn the exemption puts critically endangered species at greater risk, specifically naming the Rice's whale and the Kemp's ridley sea turtle. They argue the move is unnecessary, pointing to a record high of 714 million barrels of oil produced in the Gulf in 2025 as proof that the ESA does not constrain production. The coalition further states the exemption will not lower gasoline prices and is merely a gift to the oil industry to maximize profits. Critics also assert the administration is invoking national security to address a crisis of its own making, unrelated to domestic environmental regulations.
